This Privacy Policy ("Policy") is adopted by LabEspy in order to maintain clear standards of privacy, security and confidentiality with customer information. This notice describes how we may use and disclose your personal and/or medical information. It also describes your rights and our legal obligations with respect to your identifiable information. This policy applies to our websites, mobile applications, email and text messages, and social media accounts (the "Platforms"). When you use the Platforms, you agree to the terms in this policy.

Identifiable Information

When you visit the Platforms, LabEspy may collect any or all of the information that you give, including your name, address, telephone number, fax number, and email address together with any other information that may be needed from time to time to process a request. If provided we may also collect information about the lab tests or kits you order and the results thereof. This information will help you monitor, track and manage your health and wellness through our Platforms. But if you chose to, you can operate our Platforms without divulging any personal information.

LabEspy may also collect information regarding your usage of the Platforms like search history, IP address, screen resolution, browser used, operating system & settings, access times, referring URL etc. If you are using a mobile device, we may also collect data that identifies your device, your settings and your location using IP address mapping, WiFi, GPS signals, cell tower positioning or other technologies. Third parties under contract with LabEspy may also use Cookies or Web Beacons to collect information about your usage of our Platforms that is anonymous and not containing any personal information about you.

If you choose to register, we will collect your email address, password, location and other preference information you provide us. If you choose a third-party service, like Facebook, Google etc., to register or login, you are permitting us to use and store the information related to the account.

When you give us personal information, you are telling us that the information is true, accurate, complete and current. You are also telling us that you have the authorization to provide it to us.

Using Identifiable Information

LabEspy collects and uses your personal information to operate and improve our Platforms and services, to protect our property and to prevent damage to them. LabEspy also uses your personally identifiable information to inform you of other products or services available, display relevant advertising and recommendations, and contact you via surveys to conduct research.

We use location information, the Labs and Kits you view while on our Platforms, the referrer information and, if you are a registered user on our Platforms, your account information in order to provide you with better and faster service.

We partner with a third party ad network to either display advertising on our Platforms or to manage our advertising on other sites. Our ad network partner uses non-personally identifiable information about your activities on our and other Platforms to provide you targeted advertising based upon your interests.

We use your contact information to send alerts and notifications you have subscribed to, including to your mobile device, to solicit reviews about your opinion of current services or of potential new services that may be offered, to respond to your enquires and feedback when you contact LabEspy customer service, to send you information servicing and administrative emails and also marketing emails from a LabEspy address regarding our services or those of our partners, if you have opted-in to receive emails from us or have transacted with us, and as permitted by law.

Disclosing Identifiable Information

We may share your personal information with our corporate affiliates and with third parties for our legitimate business purposes as permitted by law. We may also share your information as otherwise described to you at the time of collection. If you book through the Platforms, certain content and services offered to may be served by non-LabEspy websites, that we may share your personal information, like the payment service providers and the medical vendors you have booked with. You should be aware that any information you disclose once you access these other websites is not subject to this Policy. LabEspy does not endorse and is not responsible for the privacy practices of third party websites and how they use your Personally Identifiable Information. If you provide us a review of a product, you authorize us to publish it on all our Platforms under the screen name you provided. You also authorize us to aggregate it with other reviews.

LabEspy may share data and aggregated information with trusted partners to help us perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide these services to LabEspy, and they are required to maintain the confidentiality of your information.

All LabEspy Platforms will disclose your health and personal information, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) comply with legal requirements as set forth by the Health Insurance Portability and Accountability Act (HIPAA) b) conform to the edicts of applicable state and federal laws such as a regulation, search warrant, subpoena or court order and administrative or criminal investigations; (c) protect and defend the rights or property of LabEspy; and, (d) act under exigent circumstances to protect the personal safety of users of LabEspy, or the public.

In the event that LabEspy (or part of its business) is acquired by another company, your personal information may be part of the assets transferred to the acquiring party for the uses set out herein.

Kids Identifiable Information

LabEspy is not directed to children under the age of 13. We assume our website is used by adults or minors supervised by a parent or guardian. We respect the privacy of parents and children and are committed to complying with the Children's Online Privacy Protection Act ("COPPA").

LabEspy does not knowingly collect personal information from minors. If we become aware that a minor is attempting to submit personal information, we will remove this information from our records. If you are the parent/legal guardian of a minor who has given us personal information, please contact us so we can delete it.

Cookies and other tracking tools

We (or our suppliers) use several common tracking tools. LabEspy uses these tools to collect usage and demographic information about you over time and across different Web sites when you use our Platforms. We also have third parties (e.g. advertisers) that collect personal information this way. We and our advertising partners may also use web beacons (single pixel GIF images). These web beacons are placed in the code of a Web page or an email newsletter. By using the Platforms, you give us your free, unambiguous and informed consent to the use of any of the cookies and tracking tools mentioned in this policy. LabEspy uses tracking tools for following purposes

  • To track new visitors to the Platforms.
  • To help us recognize your browser as a previous visitor. This includes saving and remembering any preferences that may have been set while your browser was visiting the Platforms, such as language.
  • To store your username and password if you are registered with us.
  • To work with online advertising companies to display targeted advertising on our Platforms and third party platforms that you visit. This targeting may be based on information you submit on our Platforms or third party platforms. This targeting may also be based on your activities or behaviors on our Platforms or those of third parties. We may also obtain information about your browsing history from our business partners.
  • To help improve our website offering and for capacity planning purposes. We or our third party service providers may set analytics cookies. These allow us to gather aggregated or segmented information about the types of visitors that access our Platforms and the pages and advertisements that they view. We do not use this information to personally identify you.

Some browsers have a "Do Not Track" feature that lets you tell websites that you do not want to have your online activities tracked. These features are not yet uniform, so we are not currently set up to respond to those signals.

You may review the privacy policies of those websites and/or receive specific information regarding the privacy policies and procedures of those websites after leaving the LabEspy.

Framing

In some scenarios LabEspy pages utilize framing techniques to serve content from service providers while preserving the look and feel of our site. Please be aware that when you input your information on the framed pages on our site, you are providing your personal information to these third parties through our website, and not to LabEspy.

Social Media Features

LabEspy Platforms include Social Media features, such as the Facebook button, "Like" button and Widgets, such as the Share this button or interactive mini-programs that run on our site. These features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the feature to function properly. Social Media Features and Widgets are either hosted by a third party or hosted directly on our Site.
